Child Dead After Left in SUV by Daycare Driver
Posted on Tuesday, July 29th, 2008 at 9:07 am
Milwaukee- A four month old boy was found dead inside the day care SUV that picked him up last Thursday morning. The driver of the Kuddle Kare Day Kare vehicle has been called in the state district attorney’s office for questioning. Police are still deciding whether to file charges against the woman who picked up the baby at 9:15 in the morning.
Another employee noticed the infant in the vehicle after 3 in the afternoon and called 911. The boy was found dead at the scene. The day care received citations last week for “premises not in good condition.” It was also cited in March for having unqualified workers. A spokesperson for the Illinois Department of Children and Family Services said the department has suspended Kuddle Kare’s license and will revoke it. The day care will remain closed until the police and department have finished investigating.

Doctor Faces Criminal Charges
Posted on Friday, July 18th, 2008 at 2:07 am
Cape Cod district attorney Michael O’Keefe is pushing for the criminal indictment of Dr. Rapin Osathanondh, after an abortion he performed resulted in death. The doctor allegedly failed to monitor his 22-year-old patient after putting her under anesthesia and then hesitated to resuscitate the young woman after she stopped breathing.
Doctors do not typically face criminal charges when their patients suffer injuries due to medical negligence. However, an indictment was handed down after an investigation by police and the Massachusetts Board of Registration in Medicine found Osathanondh’s conduct to be “willful, wanton, and reckless.” The terms willful, wanton and reckless establish criminal intent.
During a state investigation, Osathaliednondh lied about his action and the equipment he had available. “Suffice it to say, there was an inattention to the kinds of procedures of a lifesaving nature that one would expected in a place where an operation with anesthesia is being performed. There was nobody monitoring her, long enough to result in her death,” said O’Keefe to the Boston Globe.
Medical Malpractice is typically a civil matter, punishable under personal injury law. Chicco recalls car seat base
Posted on Tuesday, July 15th, 2008 at 6:07 am
Chicco Inc. has issued a recall on 18,000 of their KeyFit and KeyFit 30 Car Seats manufactured between February 26, 2008 and March 17, 2008. The recall concerns only the base of the car seats, which are sold with the KeyFit, KeyFit 30 and Cortina Travel Systems as well as separately.
A child is more vulnerable to injury in an automobile accident if the defective bases were installed with the LATCH method. The webbing used to tighten the base of the car seat can slip through the adjustment lock. If the webbing were to slip during a car wreck, the child safety seat could move, increasing the possibility of injury to the child.
Families who have purchased the car seats manufactured with these bases should contact Chicco toll-free at 1-800-807-8817 for a replacement base.
If you were involved in an automobile accident in which your child may have suffered injuries due to a defective KeyFit or KeyFit 30 car seat base, contact the Kenosha product liability lawyers of Habush Habush & Rottier S.C. ® at 1-866-499-4700 to discuss your case and to determine your legal options.
