Hours of Service Violations

Trucking companies have the dual responsibility of making sure the goods they are transporting arrive in a timely manner and that the drivers manning their vehicles are attentive and safe on the road. Unfortunately, some trucking companies choose to sacrifice the safety of their drivers and others on the road for more deliveries made in a shorter amount of time. Sadly, this often results in serious accidents that leave people with life-altering injuries.

Allowing or encouraging drivers to violate federal hours of service regulations is illegal, and victims of accidents that result from these violations may be entitled to financial compensation from the trucking company for their injuries. At Habush Habush & Rottier S.C., our Kenosha trucking company negligence attorneys are dedicated to helping victims of truck accidents when the trucking company fails to follow the federal hours of service regulations. Hours of Service Regulations

The federal government sets out guidelines for the amount of time a driver can be behind the wheel when working a truck driving shift. These regulations include:

  • Drivers are prohibited from driving longer than 11 hours while on a 14 hour shift
  • Drivers are prohibited from being on duty for longer than 60 hours during a 7 day period
  • Drivers are prohibited from being on duty for longer than 70 hours during an 8 day period
  • Drivers are permitted to reset their on-duty hours if they spend 34 consecutive hours off-duty (with certain stipulations)

When a driver is suffering from drowsiness while driving, any number of fatal mistakes may be made. By following hours of service regulations, trucking companies can prevent numerous accidents.
