A 63 year-old woman is suing her nursing home and its owner for neglect after an employee allegedly sexually assaulted her in 2009.
The resident, who suffers from expressive aphasia, claims the nursing home acted negligently in hiring the man. A two-day trial found the 50 year-old employee not guilty. However, her lawyer asserts, the not guilty decision does not take away the nursing home’s accountability.
Both the owner and the nursing home itself are facing eight counts, two each, of breach of contract, negligence, and violations of state regulations and the Consumer Protection Act.
