Missouri Supreme Court overturns law that capped medical malpractice damages

The Supreme Court of the state of Missouri has overturned a 2005 law that placed a $350,000 cap on the noneconomic awards that medical malpractice victims after taking their cases to trial.

The limit became a law in an attempt to fight wildly increasing malpractice insurance premiums that were driving doctors out of the state.

Missouri’s supreme court declared the law contrary to the state’s constitution in a 4-3 decision. The majority opinion was that the limit infringed on a jury’s power to assess facts and damages in a case.
